However, if you wish to become a customer you should contact us either by e-mail via the “Contact Us” or “Demonstration” sections of this Site or at the address shown on our “Contact Us” page. Once you have registered as a customer you will have access to the non-public parts of this Site.

1.2 Our privacy policy also applies to the public part of this Site.

1.3 All services to customers provided via this Site will be governed by these Terms, our privacy policy and by the terms and conditions set out in the Agreement for the provision of the Services and the Electronic End User Licence which are only available on the non-public part of this Site.

2. Intellectual property

2.1 The “Yellowblox” name, logo, corporate symbols and trade marks are the sole property of Yellowblox.com Limited (“Yellowblox”) and no permission is given in respect of their use. This Site and its contents are protected by UK and international copyright laws and other intellectual property rights. Unless otherwise indicated, Yellowblox is the owner of the copyright and all other intellectual property rights in the Site and its contents. Save as set out below, no part of the Site may be reproduced, modified, copied or used for any commercial purpose without the prior written permission of Yellowblox.

2.2 You may retrieve and display the content of the Site on a computer screen, or print copies of such content (including these Terms) for your own personal use, provided you keep intact all and any copyright and proprietary notices.

3. Site availability

While Yellowblox endeavours to ensure that this Site is normally available 24 hours a day, Yellowblox shall not be liable if for any reason this Site is unavailable at any time or for any period. Access to this Site may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond Yellowblox’s control. Your access to the Site and your ability to participate in all or certain parts of the Site may be terminated by Yellowblox at any time without notice and without any liability. Any limitations on Yellowblox’s liability will survive such termination. Yellowblox shall use best endeavours to send a courtesy email advising of the non-availability of this site.

Yellowblox is not responsible for the contents of any website operated by a third party which may be accessed via this Site, and Yellowblox does not accept any obligation, gives no assurance, and assumes no liability or responsibility (whether express or implied) in relation to any content on any other website. 5.2 Whilst Yellowblox makes reasonable attempts to exclude viruses or other destructive computer codes from the Site, it does not accept any obligation, gives no assurance and assumes no liability or responsibility (whether express or implied) in relation to viruses or such computer code. You should take all appropriate safeguards before using the Site or downloading from the Site.

5.3 Nothing in this Section 5 applies to Yellowblox’s liability for services purchased through the Site, which is governed by to our Agreement for the provision of the Services.

6. General

6.1 This Site and the information on this Site may be changed or updated without notice, unless specified by us to the contrary. Yellowblox may revise these Terms and any other legal notice on the Site (including the privacy policy). All changes will be effective when posted on the Site and agreed by the user. You should check this Site from time to time to review these Terms and other legal notices, because they are binding on you.

6.2 If any provision of the Terms is deemed unlawful, void or for any other reason unenforceable then that provision shall be deemed severed from the Terms and shall not affect the validity and enforceability of any remaining provisions.

6.3 Yellowblox’s failure to exercise or enforce any rights or any provision of the Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by Yellowblox in writing.

6.4 General words shall not be given a restrictive interpretation by reason of their being preceded or followed by words indicating a particular class of acts, matters or things.

6.5 The parties do not intend the Terms (or any part of them) to be enforceable by any person who is not a party to these terms pursuant to the Contracts (Rights of Third Parties) Act 1999.

7. Governing law

The Terms and your use of this Site shall be governed by English law. By using the Site and accepting the Terms you submit to the exclusive jurisdiction of the English courts, save that Yellowblox may take action in any appropriate jurisdiction to protect its intellectual property rights or to recover any amount owed to Yellowblox.
